You are a judge, actually a Justice, at the New York Supreme Court, Criminal Division, Kings County. You are called upon to pass sentence on Michael Carter, convicted of one count of assault in the first degree, in violation of New York Penal Law, Section 120.10, a class B felony which carries a maximum prison sentence of 25 years. The pre-sentence investigation report (PSR or PSI) states that the defendant is 32 years of age, married, father of two children, 6 and 7, who depend on the defendant for financial and emotional support. Mr. Carter has worked for the MTA as a train conductor for over 7 years. This is Mr. Carter’s first offense. The victim of the assault is Craig Wilson, 22, high school dropout, single, no children. The assault took place in the course of a violent incident in which someone threw excrement (feces) on Mr. Carter’s face while he was at work. Mr. Carter mistakenly thought Mr. Wilson had thrown feces on his face and proceeded to assault him. The assault was very serious. Mr. Wilson sustained injuries to his left eye and may be left with permanent vision impairment from that eye, though not complete loss of eyesight. During the trial, Mr. Wilson testified that during the attack he repeatedly told Mr. Carter: “It was not me,” but that only made Mr. Carter angrier and he kept pounding Mr. Wilson’s face. A subsequent investigation revealed that Mr. Wilson had not thrown feces on Mr. Carter’s face. Another man who looked very much like Mr. Wilson had been the culprit. You can sentence Mr. Carter to anywhere from 5 to 25 years in prison.
