Your day at the Snappy Cookie Company (SCC), a non-union company, started calmly. Well before dawn you drove to SCC’s facilities on the outskirts of town, past the factory (already emitting the aroma of baking cookies), through the full employee parking lot, and parked in front of the main office building, which faces the town’s main thoroughfare, Stanton Road. You settle at your desk in the HR office, log onto your computer, and start to dig into the pile of work that awaits you. But within minutes your phone rings and Fred, a security guard, tells you that:About ten people just walked into the employee parking lot and are putting leaflets under windshield wipers;Three people are standing on the covered porch entrance to the cookie factory, handing out leaflets and approaching anyone entering or leaving the building;Someone is standing on the sidewalk in front of the main office building where you work; Three people are walking back and forth in Stanton Road and, Two people are standing on the other side of Stanton Road, holding a large banner of some sort.Fred says that it’s still too dark for him to get a good look at any of them, but they’re all wearing some kind of union jacket. He says that he called you as soon as he noticed what was happening and he’s not approached anyone yet.Your Assignment for Question 1: Please formulate an action plan. What will you need to know more about? What factors could be relevant to SCC’s right to eject these people? As you sort through the possibilities and options, please identify and describe the law that will determine what questions you need to ask and the steps you’ll take, depending on the answers to those questions. Be sure to provide specific identifying information for the statutes, cases (the name of the case, and a citation) and legal principles that you reference.Question 2 You’ve helped Fred address the morning’s issues, managed to get some other work done, and are about to sit down to have lunch at your desk when your phone rings again. This time it’s John, the plant manager, who reports that:About 30 minutes ago he walked down the hall and looked into the employee lunchroom, which has a wall of windows. Through them he could see the first shift employees enjoying their 30-minute unpaid lunch break. The room was full of hourly employees, all of whom he recognized. About ten employees wearing red T-shirts and hats with union insignias appeared to be “working the room,” circulating among the tables, talking to other employees, passing out fliers, and asking co-workers to sign some kind of card.John reports that although he peered through the windows for quite a while, he couldn’t get a good look at the fliers or cards. Nor could John hear what the employees were saying, but it looked like they were trying to promote a union. When some of the employees wearing red T-shirts and hats left the lunchroom, he followed them and saw them go onto the plant floor, interrupt employees who were working, pass out fliers and ask them to sign cards.John offers to bring you a list of the names of the employees wearing the red shirts and hats and the names of employees who appeared to be receptive to the material. He also offers to show you the pictures that he took of the lunch room and plant floor activity. John intends to ask the ten employees to turn over all cards that they obtained from employees and call a mandatory meeting of all SCC employees, where he will ask each of them, point-blank, whether they support a union and set them straight if they answer in the affirmative. In addition he intends to order the employees to refrain from all of this activity and ban the red T-shirts and hats from areas of the plant, including the lunchroom. And, he wants to discipline anyone who fails to follow his directives. Your Assignment for Question 2 What will you advise him, and why? How would you respond to each element of his proposed plan of action? Is there anything else that you would bring to his attention, either by way of caution or as otherwise? Is there any additional information that you would need to formulate your thoughts? If so, what is it and why would you like to have it? Be sure to discuss the applicable legal principles from our course reading that would support what you say to John. Please provide specific identifying information for the statutes, cases (the name of the case, and a citation) and legal principles that you reference.
