Case Brief instructionsInstructions for Case Briefs The brief should be broken down -into five sections as follows: 1. Facts – A short summary of the relevant facts including a description of the case got to the Board or Court; 2. Issue – The main point of concern or issue that is being addressed in the case. I suggest phrasing it in the form of a question; 3. Rule – A summary in your own words describing what the case indicates is the relevant law applicable to the situation. Do not just cite the case name or statute number. That is insufficient without a description; 4. Application – You need to apply the Facts to the Rule in answering or addressing the question listed in the Issue. This is the most important part of the brief as it is your analysis. It is generally the longest or second longest part of the brief depending on how detailed you are with the Facts. Again, I am looking for analysis and not a book report; and 5. A short sentence or two summarizing the Board’s or Court’s final disposition of the case. Please use only the attachment to do the brief.
