Here is another example: Justice Thomas dissented from the majority opinion in case Grutter v. Bollinger. Why do they do that? Use the opinion of Justice Thomas on Grutter v. Bollinger, https://www.law.cornell.edu/supct/html/02-241.ZX1.html, as the exhibit to start a conversation, make a claim to answer the question above.Justice Thomas’s whole career has been based on the fact that those barriers were struck down. There is an inherent contradiction there, where he is saying that integration doesn’t matter, or is not an important factor allowing him to sit on the bench with other eight white judges, his whole career has pretty much been like that. That is the contradiction. This research project is to make sense of this dissonance. For example, what might be some of the reasons that Justices Thomas holds those views and thinks that integration isn’t going to benefit. It could be like that he really struggled with how his career went and felt that integration didn’t benefit him, it could be that there is a certain theory that with groups who are marginalized or who are oppressed, they sort of believing that only a couple of people could rise to the top, there is only room for a certain number of women, or a certain number of black people rise to the top of an organization, so it brings this type of competition, within the minority group rather than the dominant group. That might be one way to think about it. Maybe Justices Thomas thinks that, in fact, there is this mythology, thinking about within African American community, has been a long time, that the way that black people can overcome oppression, is through hardworking and perseverance and individualism, and maybe Justice Thomas has really taken this to his heart and uses his own success as entirely on his own merit, and his own work, and he doesn’t understand why other people can’t do the same. He is sort of like, extrapolating from his own life story, which is an extraordinary one and thinking that everybody’s life story must be like his.
