Question: In R (Miller) v Secretary of State for Exiting the European Union [2017] UKSC 5,at [146], the Supreme Court stated that,Judges … are neither the parents nor the guardians of [constitutional]conventions; they are merely observers. As such, they can recognisethe operation of a political convention in the context of deciding alegal question … but they cannot give legal rulings on its operation orscope, because those matters are determined within the politicalworld.

Given how important constitutional conventions are to the operation of the UK constitution, the Supreme Court’s approach raises the question of how conventions are binding, and whether at least some should be replaced by legal rules, so that they can be enforced by the courts.
