The first case, Cherokee Nation v Georgia, concerned the case brought by the Cherokee asking the Court to stop the State of Georgia from taking their lands. They brought their suit as a “foreign state” claiming that Georgia had no right to impose its laws on foreign states. The Court ruled that the Cherokee were a “domestic dependent nation” and not a “foreign state.” This meant that they could not sue in the same way a foreign state could and the Court did not have jurisdiction.
