Please answer the two subjects below, Twenty-Eighth Amendment & Miranda Rights. Thank you!

Twenty-Eighth Amendment
Assume that you are not satisfied that the Constitution protects a right to individual privacy and that you are convinced a “twenty-eighth amendment” needs to be written to protect such a right. If you were to draft such an amendment that would explicitly protect the right to privacy, how would you define the right to privacy? What activities would you include within this right if you were to draft such an amendment? Are there cases on point that support your definition and the activities that you believe should be included? Cite your sources.

Miranda Rights
As you now know, a suspect’s Fifth Amendment right to protection from self-incrimination begins when police engage the suspect in a custodial interrogation. There are three basic elements to a custodial interrogation. Provide each one and describe its requirement in detail.
Prior to arrest, does a person have to respond to police questions that are considered investigatory? What are the consequences if the court determines that the officer violated the defendant’s rights by not reading the Miranda Rights? Do you feel these are appropriate consequences? Why? If you don’t believe they are appropriate consequences what do you believe the consequences should be, if any?
