Often a defendant will claim his defense attorney at the trial court level was “ineffective” under the 6th Amendment.For this writing assignment, I want you to read the seminal case established the constitutional standards for ineffective assistance of counsel, Strickland v. Shearin, 706 F.3d 356 (4th Cir. 2013). Then, write a dissenting opinion which disagrees with the Merzbacher majority and argues that the defendant received ineffective assistance of counsel and therefore should have been granted habeas relief. Be sure to apply the two-part framework outlined in Strickland.
